Ce este si cum se obtine formularul A1?

Pentru salariatii companiilor din Romania care urmeaza sa presteze activitate intr-o tara membra UE pe timpul contractului de munca incheiat in Romania, companiile trebuie sa obtina formularul A1 care atesta ca salariatii sunt asigurati in sistemul de securitate sociala din Romania.
Cine si de unde obtine formularul A1?
Obtinerea formularului A1 se face prin grija angajatorului de la Casa Nationala de Pensii Publice.
Angajatorul depune dosarul pentru obtinerea formularului A1 inainte ca angajatul sa plece din tara, pentru ca acesta trebuie sa aiba cu el formularul A1. Altfel, in caz de control, societatea este sanctionata.
Care sunt documentele necesare obtinerii formularului A1?
Dosarul pentru obtinerea formularului A1, sau formularelor A1 (daca sunt mai multi salariati detasati in aceeasi perioada se face un singur dosar pentru toti), se depune la Casa Nationala de Pensii Publice si trebuie sa contina:

  1. cerere pentru obtinerea Formularului A1 – se descarca de aici;
  2. certificatul de inregistrare al societatii emis de Registrul Comertului;
  3. certificat de atestare fiscala valabil, emis de ANAF-ul de domiciul prin care se face dovada ca societatea nu are datorii catre bugetul de stat; Certificatul de atestare fiscala are valabilitate 30 zile de la emitere, la data depunerii dosarului trebuie sa fie valabil.
  4. declaratie pe propria raspundere din partea angajatorului privind numarul total de salariati, si cati dintre acestia sunt detasati, precum si documente doveditoare. Ca document doveditor eu adaug extras din Revisal cu salariatii activi.
  5. certificatul constatator al societatii pentru luna in care se depune dosarul;
  6. situatiile financiare ale societatii – cea mai recenta balanta si cel mai recent bilant depus, semnate/stampilate;
  7. declaratie pe propria raspundere a angajatorului privind cifra de afaceri atat cea obtinuta in ultimul an cat cea si de la data infiintarii. O cerinta obligatorie pentru ca dosarul sa nu fie respins este ca cel putin 25% din cifra de afaceri sa fie realizata pe teritoriul Romaniei in baza contractelor comerciale incheiate in Romania. Sumele mentionate vor fi defalcate intr-un document separat.
  8. contractele de prestari servicii incheiate pe teritoriul Romaniei anterior perioadei de detasare si in perioada de detasare;
  9. contractele de prestari servicii incheiate de angajator cu angajatorul din tara unde se dispune detasarea salariatilor, obligatoriu tradus in limba romana.
  10. ultima declaratie 112 depusa de societate impreuna cu Anexa 1.1, Anexa 1.2 si recipisa.
  11. copie dupa cartea de identitate si copie dupa contractul individual de munca/actul aditional de detasare al salariatului ce urmeaza a fi detasat;
  12. adeverinta privind stagiul de cotizare in ultimele 12 luni, emisa de Casa de Pensii Judeteana pentru fiecare salariat detasat. Pentru salariatii care nu au stagiu de cotizare cel putin o luna inainte de detasare, certificatul A1 nu se elibereaza cu data solicitata ci cu o luna mai tarziu. Ex. Daca solicit formular A1 cu data de 01.07 dar salariatul nu a avut stagiu in luna 06, formularul A1 va fi eliberat cu data de 01.08, luna iulie nu va fi acoperita de A1, chiar daca am depus dosar.
  13. declaratie pe propria raspundere a angajatorului care atesta faptul ca salariatul/salariatii au mai avut sau nu formular A1. Daca au mai avut se mentioneaza perioada.
  14. declaratie pe propria raspundere a angajatorului care atesta faptul ca salariatii detasati nu inlocuiesc alti lucratori detasati, daca au avut sau stagiu de cotizare cel putin o luna inainte de detasare, si ca salariatii nu au mai fost detasati pe perioade care depasesc 24 luni consecutive.

Ce faceti cu formularele A1 ale angajatilor incetati pe perioada valabilitatii acestora?
Formularele A1 ale persoanelor incetate pe perioada cand acestea sunt valabile, trebuie returnate la Casa de Pensii cu proces verbal.
Se poate prelungi perioada certificatului A1?
In cazul in care se prelungeste perioada de detasare a salariatului trebuie prelungit si formularul A1.
Pentru prelungirea formularului A1 se depune dosar la Casa de Pensii cu documentele mentionate mai sus, plus actul aditional de prelungire si declaratia angajatorului prin care mentioneaza ca salariatul respectiv a mai avut formular A1 pe perioada X.
Exista o perioada maxima pe care se elibereaza A1?
Formularul A1 se poate elibera pe o perioada maxima de 24 luni consecutive, cu posibilitatea de prelungire pana la 36 luni daca salariatul face o pauza de o luna, pauza in care se intoarce in Romania.
Din practica
Deoarece procedura de obtinere a formularelor este de durata, este suficient sa puneti la dispozitia organelor de control cererea de obtinere inregistrata de Casa Nationala de Pensii Publice, iar salariatii in cauza sa fie in cerere.
O cerinta importanta a Casei de Pensii este numerotarea paginilor tuturor documentelor si declararea numarul de pagini pe care il contine dosarul, astfel incat sa se evite orice neintelege privind ratacirea vreunui document.

Who and how do you get the A1 form ?
The employer has to take the A1 form from The National House of Pensions.
The employer has to submit the A1 aplication while the employee is still in the country, otherwise, in case of an inspection, the company is penalised.
What documents do you need to get for the A1 form ?
The file for getting the A1 form or A1 forms (if there are more employees departing in the same day, only one form for all of them is enough), is submitted at The National House of Pensions and it is needed the following documents:

  1. Request for getting the A1 form – download here.
  2. Certificate of registration from the Trade Register;
  3. Tax registration Certificate issued by the National Agency of Fiscal Administration that proofs that the company has debts to the state budget; the tax registration Certificate is available only 30 days;
  4. Employer’s statement of the total number of employees that are departing, along with documents proof (ex: a Revisal statement with active employees);
  5. The Certificate of Good Standing of the company for the month where the file is submitted;
  6. Financial statements of the company – the last trade balance and the last balance sheet signed and stamped;
  7. Employer’s statement regarding the turnover from the past year and from the date of establishment. A very important fact that would help getting the form is that at least 25% from the turnover has to be from Romanian territory, with commercial contracts concluded in Romania. These amounts will be detailed into a separate document.
  8. Working contracts signed in Romania before departure and during departure;
  9. The service contract between the employee and the employer from the country that they are departing to, translated in Romanian;
  10. The last 112 statement filled by the company along with appendix 1.1 , appendix 1.2 and the receipt;
  11. Copy of the ID and copy of the individual working contract / additional departing paper work of the employee;
  12. The certificate regarding the subscription period from the last 12 months, issued by the County’s House of Pensions for each departing employee. For the employees that do not have the subscription period at least one month before the departure, the A1 certificate won’t be issued at the requested date, but one month later. Ex. If I ask the A1 certificate on 01 July, but the employee does not have the contributions on June, the A1 certificate will be issued on 1st of September, July won’t be covered by the A1, even though I submitted the documents.
  13. Employer’s statement attesting the fact that the employee/employees have had or not the A1 certificate. If they did, it has to be mentioned the period.
  14. Employer’s statement that attests the fact that the departing employees does not replace other departed employees, if they had or not had the contributions paid at least one month before the departure, and the fact that the employees have not been departed on a period of 24 consecutive months.

What do you do with ceased employees’s A1 contracts on it’s the availability period ?
Available A1 certificates for the ceased employees have to be returned to the House of Pensions along with a file report.
How can you extend the A1 certificate’s availability?
If it expends the departure period of the employee, it has to be extended the A1 certificate as well.
To extend the A1 certificate it has to be filled a document at the House of Pensions with the documents mentioned above, also the extensions additional document and employer’s declaration that specifies that the employee have had a A1 certificate on X periode of time.
There is a maximum period for A1 to be issued?
The A1 certificate can be issued on a maximum period of 24 consecutive months, with a possibility of extension up to 36 months if the employee has a month break, period when he returns to Romania.
Useful Facts:
Because it takes time for the certificates to be issued, it would be enough to provide the request for the A1 certificate registred to the National House of Public Pensions and the employees have to be mentioned in the request.
An important request of the House of Pensions is to number all the pages of the documents and declare the number of pages that the document has, so in this way it won’t be any misscomunication issue.
