Ce este contractul colectiv de munca?

[:ro]Contractul colectiv de munca este obligatoriu pentru societatile care au mai mult de 21 de salariati, se negociaza intre angajati si angajator si este incheiat in forma scrisa, cu scopul:

  • sa defineasca cat mai clar drepturile si obligatiile partilor;
  • sa permita angajatilor negocierea anumitor beneficii neincluse in Codul Muncii;
  • sa diminueze conflictele de munca, acele neintelegeri legate de interesele cu caracter economic, profesional sau social;

Care este procedura de negociere si incheiere a contractului colectiv de munca?
Societatile care au cel putin 21 de angajati sunt obligate sa initieze negocierea si incheierea contractelor colective de munca.
Etapele pentru incheierea contractului colectiv de munca sunt:

  • Instiintarea salariatilor despre intentia angajatorului de intocmire a contractului colectiv de munca, impreuna cu detalii depre ora si data cand are loc adunarea salariatilor pentru a-si alege persoana sau persoanele, dupa caz, care sa-I reprezinte in relatia cu angajatorul pe perioada negocierilor. In functie de numarul de salariati al societatii, se pot alege mai multi reprezentanti ai salariatilor si mai multi reprezentanti ai angajatorul.
  • Alegerea reprezentantilor se face prin vot, cu conditia ca cel putin jumatate plus unul din salariatii sa-l voteze. In urma alegerilor rezultatele se centralizeaza intr-un proces verbal. Reprezentantul da declaratie ca este de acord cu propunerea si ca isi asuma responsabilitatile rolului, iar angajatorul recunoaste reprezentantul salariatilor prin decizie interna, scrisa.
  • Se stabileste orarul intalnilor pentru negocierea contractului colectiv. Reprezentantul salariatilor se intalneste cu salariatii pentru a stabili nevoile si dorintele lor, apoi le negociaza cu angajatorul.
  • Prima intalnire este mai mult pentru a-si prezenta fiecare parte interesele, negocierile propriu zise incep din sedinta 2, cu mentiunea ca durata maxima legala a negocierilor este de 60 zile. Dupa fiecare intalnire se incheie proces verbal in care se mentioneaza rezultatele intalnirii.
  • Dupa negocieri, se intocmeste contractul colectiv de munca, in 3 exemplare, si se semneaza de toate partile implicate.
  • De retinut ca, in contractul colectiv de munca putem introduce orice beneficiu, procedura, dar nu se poate negocia si trece in acesta nimic care este sub continutul Codului Muncii. Contractul colectiv de munca poate contine elemente peste prevederile Codului Muncii, dar nimic care sa anuleze prevederile acestuia.

Unde se inregistreaza contractul colectiv de munca?
Contractul colectiv de munca se incheie in 3 exemplare, se semneaza de toate partile implicate, un exemplar ramane la societate, un exemplar la reprezentantul salariatilor si un exemplar la ITM-ul de domiciliu al angajatorului care ii da numar de inregistrare.
Numarul de inregistrare se pastreaza la sediul angajatorului si se pune la dispozitia organelor de control de cate ori este solicitat.
Ce valabilitate are contractul colectiv de munca?
Contractul colectiv de munca poate sa-si produce efecte pe o perioada de maxim 2 ani. Dupa 2 ani, se reia procedura de negociere si intocmire a acestuia.
Daca sunt in perioada celor 2 ani de valabilitate a contractului colectiv de munca, pot sa negociez alt contract colectiv?
Daca apar modificari majore in relatia angajat-angajator, se poate initia alta negociere si modificarile se trec intr-un act aditional la contractul colectiv si se inregistreaza la ITM-ul de domiciliu al angajatorului in completarea contractului colectiv de munca initial, si are valabilitate pana la expirarea perioadei pe care a fost incheiat contractul colectiv de munca.
Daca nu initiez negocierea contractului colectiv de munca primesc amenda?
Daca nu se face dovada ca angajatorul a initiat negocierea contractului colectiv de munca, acesta risca amenda intre 5.000-10.000 lei.
Din pacate multi angajatori fac doar procedura de initiere a nogocierilor si o suspenda, pentru a nu primi amenda, insa nu recunoasc scopul si ajutorul contractului colectiv, care ii poate scutii de multe conflicte.

2) The election of the representatives is made by voting, provided that at least half plus one of the employees vote. After the election, the results are centralized in minutes. The representative declares that he agrees with the proposal and assumes the responsibilities of the role, and the employer recognizes the employees’ representative by internal written decision.
3) The timetable of the meetings for the negotiation of the collective agreement is established. Employee representatives meet with employees to determine their needs, and then negotiate with their employer.
4) The first meeting is more about presenting each party’s interests, the negotiations start from the second meeting, mentioning that the maximum legal duration of the negotiations is 60 days. After each meeting, a recording of the results of the meeting is concluded.
5) After the negotiations, the collective labor agreement is drawn up in 3 copies and signed by all the parties involved.
6) To be reminded that in the collective labor contract we can introduce any benefit or procedure, but we cannot negotiate anything that is under the content of the Labor Code. The collective labor contract may contain elements above the provisions of the Labor Code, but nothing to cancel its provisions.
Where is the collective labor agreement registered?
The collective labor agreement is concluded in 3 copies, signed by all parties involved, one copy remains in the company, one copy to the employees’ representative and one copy to the Territorial Labor Inspectorate of the employer’s headquarter, which gives it a registration number.
The registration number shall be kept at the employer’s premises and shall be made available to the inspection bodies whenever required.
What is the validity of the collective labor contract?
The collective labor agreement may take effect for a maximum of 2 years. After 2 years, the negotiation and drafting procedure is resumed.
If I am in the 2 years of the collective labor contract, can I negotiate another collective contract?
If there are major changes in the relationship between the employee and the employer, another negotiation may be initiated and the changes are made in an addendum to the collective contract, and is registered to ITM of the employer headquarter in addition to the collective labor contract initially, and shall be valid until the expiry of the period of the collective labor contract.
If I do not initiate the negotiation of the collective labor contract I get the fine?
