On 30.03.2020 the Government issued the Emergency Ordinance 32 which modifies the conditions for applying the technical unemployment facilities previously regulated by GEO 30.

The benefits apply to any employer who reduces or interrupts the activity in whole or in part as a result of the effects of the SARS COV epidemic – 2

The news are:

1. The conditions to register a reduction of the incomes (by 25%) or to be unable to pay the employees are canceled and the benefits applies to all the employers who reduce or interrupt the activity totally or partially due to the effects of the SARS COV epidemic – 2
2. The need to obtain the certificate of emergency status is eliminated
3. the limitation of the benefits to maximum 75% of the employees is canceled.
4. In the situation where an employee has several employment contracts, of which one full-time remains active, he does not benefit from the technical unemployment allowance.
5. The employer may supplement the allowance above the average gross salary in the economy up to a minimum of 75% of the gross salary of the employee’s contractual salary.
6. Applications are submitted starting with April 1 for March and starting with May 1 for April
7. The Employment Agency makes the payment within 15 days from the submission of the application.
8. The payment of the net allowances is made within a maximum of 3 days from the refund of the amounts by the Employment Agency.

We remind:
According to art. 52, paragraph (1), lit. c) from the Labor Code, during the period of technical unemployment, the employees are entitled to an allowance of 75% of the salary. The allowances thus paid will be refunded from the unemployment insurance budget, within the limit of 75% of the average gross salary per economy.

The measure is valid for the period in which the State of Emergency is established.
