Emergency situation certificate

The Ministry of Economy, Energy and Business Environment issues emergency situation certificates based on the supporting documents submitted by entities whose activity is affected in the context of COVID-19. According to Order 791/2020, there will be two types of emergency situation certificates (CSU), one blue and one yellow, and companies will be able to obtain one of them through an online procedure. Emergency situation certificates (CSU) will be issued in two alternative forms:

1. BLUE – for the applicants who request it based on the declaration on their own responsibility issued in the form presented in the Annex no. 3, where they declare the total or partial interruption of the activity.
2.YELLOW – for the applicants who request it on the basis of the declaration on their own responsibility issued in the form presented in the Annex no. 3, where they declare a decrease in receipts in March 2020 with a percentage of at least 25% compared to the average of the receipts from January – February 2020.

The blue certificate will allow the holder to reimburse the technical unemployment benefits and to postpone the payment of the utilities and the rent.

The yellow certificate will allow the holder to reimburse the technical unemployment benefits within the limits provided by Ordinance 30 (maximum 75% of the average gross salary in the economy for maximum 75% of the employees).

In order to obtain the Emergency Certificate, the applicant submits the following documents:
– Identification data;
Statement on the legal responsibility of the legal representative, by which he attests that all the information and documents underlying the request for obtaining the certificate are in accordance with the reality.

The aforementioned documents are uploaded to the platform http://prevenire.gov.ro/ under the electronic signature of the legal representative of the economic operator or of his authorized representative holding such electronic signature.

In case the legal representative does not hold the electronic signature, he can sign on paper, following that all the documents uploaded (including the declaration on his own responsibility) will be signed electronically by the designated representative.

The Ministry of Economy will prepare the electronic platform accordingly within 5 days.
