E-Invoice:

1. In the B2G commercial relationship, the invoices will contain the corresponding CPV codes provided in the reference nomenclature in the field of public procurement
2. In the B2C commercial relationship, invoices will be sent through the E-Invoice system. If the buyer does not provide the CNP, the issuer will complete the dedicated field with 13 digits of zero.
3. Exceptions to E-Invoice:

– Fiscal receipts that meet the conditions of simplified invoices

– Intra-Community deliveries of goods between Romanian companies, where the beneficiary has a VAT code valid in another member state.

– Transactions between Romanian persons for which the place of delivery/performance is not in Romania.

E-VAT:

The application of the sanctions is postponed until July 1, 2025.

Fiscal code:

1. Profit tax

Clarifies the calculation method of the additional tax of the fiscal groups for the energy fields and financial institutions.

2. Income tax

– As an exception to the rule of withholding tax on rental income, in the case of rental income paid in kind, the declaration and payment of the tax is made by the owner, through the personal income tax declaration.

– Clarifications regarding the tax on the income from the transfer of real estate from the personal patrimony (especially regarding the dismemberment of the right of ownership).

3. VAT

– In the simplified invoices issued to a taxable person or a non-taxable legal entity, we will also indicate the VAT code or the fiscal code of the beneficiary

Accounting law:

– The trial balance will be drawn up monthly

– The deadlines for submitting financial statements will no longer be expressed in days (150/120 days from the end of the financial year) but will be May 31/April 30 (depending on the type of entity) of the year following the one for which they are drawn up .

E-Transport:

The obligation of transporters to equip themselves with a positioning device and to transfer the vehicle’s positioning data throughout the transport is postponed until 31.03.2025.
