Companies with over 50 employees will pay not 50% but 100% to the disability fund

Emergency Ordinance no. 60/2017 for amending and completing the Law no. 448/2006 on the protection and promotion of persons with disabilities rights was published in the Official Gazette no. 648/7.08.2017.

Law no. 448/2006 on the protection and promotion of the rights of persons with disabilities currently stipulates that legal persons, public or private, having at least 50 employees, have the obligation to employ disabled persons as at least 4% of the total number of employees.

Starting 1 September 2017, entities not employing disabled persons will pay monthly to the state budget an amount representing the minimum gross salary per country guaranteed to payment multiplied by the number of jobs that did not employ disabled persons.

Until the appearance of Ordinance 60/2017, entities could either pay monthly 50% of the gross minimum wage multiplied by the number of jobs where they did not employ disabled persons or to buy products and services made by people with disabilities.

The Ordinance is applicable starting with 1 September 2017.
