[vc_row][vc_column][vc_column_text]Emergency Ordinance no 6\/2015 amending Law no. 571\/2003 regarding the Fiscal Code, was published into Official Gazette no 250\/14.04.2015.<\/p>\n

VAT<\/strong><\/p>\n

The reduced VAT rate of 9% will apply for the delivery of the following goods:<\/p>\n

– foods, including beverages, excluding alcoholic drinks, live animals and bird
\ns, seeds, plants and ingredients used in the preparation of food, products used to supplement or replace food;
\n– restaurant and catering services, excluding alcoholic beverages.<\/p>\n

Income Tax<\/strong><\/p>\n

In case of transfer of real estate from the personal patrimony by judicial decisions or by other procedures, the tax payable by the taxpayer is calculated and collected by the competent tax authority, based on a tax decision, within 60 days from the date of communication of the decision.<\/p>\n

In case of transfer by foreclosure are applicable the same tax obligations.<\/p>\n

Registrators in the land registry offices have no obligation to verify the payment of income tax from the transfer of real estate property from the personal patrimony.<\/p>\n

For income from rental of goods, in case of termination, during the fiscal year, of contracts concluded between the parties, in which the rent is equivalent in lei of a sum in foreign currency, prepayments will be recalculated by the competent tax authority at the request of the taxpayer, based on supporting documents.<\/p>\n

Determination of annual income is performed based on the exchange rate of the currency market, communicated by the National Bank of Romania, the day before the tax decision is issued.<\/p>\n

Tax on income obtained from Romania by non-residents<\/strong><\/p>\n

It is regulated the tax treatment of interest income derived from Romania by legal persons resident in a Member State of the European Union (EU) or European Economic Area (EEA).<\/p>\n

Interest income derived from Romania by a legal person resident in an EU Member State or EEA State with which Romania has concluded a Convention for avoidance of double taxation, are subject to a similar tax treatment of interest income derived by resident legal persons such as tax rate, terms for declaration and payment of corporation tax on income from interest, etc.<\/p>\n
